This book consists of a series of tables that provide a reference guide to the mining legislation of each province and territory in Canada. Each table covers one particular subject in mining law, from preliminary licensing requirements to acquisition of mineral interests and the transfer of such interests. It shows how that particular subject is treated in each jurisdiction by briefly outlining the applicable legal principles. A statutory reference is always provided so that the detailed language of the legislation can easily be looked up.
More particularly, the guide covers the rights required for the exploration, development, and production of metallic minerals and industrial minerals, such as asbestos, but does not cover placer mining, petroleum and natural gas, bituminous sands, or coal. It concentrates on the most commonly acquired interests in minerals, such as claims and leases, and does not cover legislation dealing with incidental aspects of mining, such as taxation, environmental protection, or incentive schemes.
The last chapter is a visual guide in chart form of the process by which one could acquire mineral rights and take them through to lease and finally to patent. With one glance at the chart for each province, it is possible to determine the essential differences in the various provincial systems, which are quite dramatic in some cases.
This guide is an excellent reference tool that enables any researcher to do comparative analysis on various points of mining law. Used as a starting point for researchers, it could save countless hours by sending the researcher off on the right path.
