This working paper provides a concise outline of the background and present structure of the Alberta forest tenure system. The study begins with a review of the constitutional position of the forest industry, an analysis of the applicable common law and a discussion of legal techniques available for dispensing timber harvesting nights. After examining the historical background of the disposition system through the 1950s, the author looks at the introduction of the forest management agreement, timber quotas, and licensing in the mid 1960s, comparing the quota holders’ rights and obligations under both arrangements. Finally, Bankes reviews the two major tenure forms available in Alberta: pulpwood and forest management agreements. Crown Timber Rights is timely, informative, and well written.
